Welcome to XPLR Guide. These Terms & Conditions ("Terms") govern your access to and use of the XPLR Guide website, mobile application, and related services (collectively, the "App"), operated by XPLR, LLC ("XPLR," "we," "our," or "us").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the consent of a parent or legal guardian.
2. Purpose of the App
- Local exploration guides
- Curated places, trails, food, attractions
- Day trips, road trips, and category-based discovery
- Map-based navigation and saved favorites
- User accounts and personal lists
- Optional premium upgrades or membership features (if applicable later)
The App is intended for general informational and entertainment purposes. It is not a travel agency, tour operator, or booking platform.
3. User Accounts
If you create an account: You must provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and all actions taken under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the App for unlawful or fraudulent purposes
- Attempt to scrape, copy, or extract data from the App
- Upload harmful content, spam, or misleading information
- Reverse engineer, decompile, or modify the App
- Interfere with servers, networks, or App features
We may monitor usage to protect the App and its users.
5. Location Data
The App may request access to your device location, GPS data, and motion or navigation inputs. You may choose to disable location access, but certain features may not function properly.
6. Third-Party Content
The App may feature:
- Business listings
- Merchant information
- Links to external websites
- User-submitted content
We do not own, operate, or guarantee the accuracy of third-party information. Visiting third-party locations or websites is at your own risk.
7. Accuracy of Information
We strive to provide up-to-date and accurate information, but hours, prices, amenities, trail conditions, accessibility, and addresses may change without notice. XPLR Guide is not responsible for inaccuracies or changes made by third-party businesses, parks, or tourism entities. Always verify details before traveling.
8. Premium Features & Payments (Optional)
If the App includes paid features now or in the future: All payments are processed by the App Store or Google Play. Subscriptions automatically renew unless canceled. Refunds must follow the policies of the App Store or Google Play. Prices may change with notice. We do not store payment information on our servers.
9. Intellectual Property
All content in the App—including logos, maps, text, photos, videos, categories, and design elements—is the property of XPLR, LLC or our licensors. You may not copy, distribute, modify, reproduce, sell, or redistribute any content from the App without written permission.
10. User-Submitted Content
If the App allows user reviews, comments, uploads, or submissions: You grant XPLR a non-exclusive, royalty-free license to use that content. You are solely responsible for what you post. You agree not to upload copyrighted, harmful, or inappropriate content. We may remove content at our discretion.
11. App Availability & Updates
The App is provided “as is” without warranty of availability, error-free operation, compatibility with all devices, or uninterrupted access. We may modify, suspend, or discontinue the App or any feature at any time.
12. Limitation of Liability
To the fullest extent permitted by law, XPLR is not liable for injuries, accidents, or incidents during trips or activities visited using the App; losses or damages resulting from using or relying on App information; errors, omissions, or outdated details in listings; third-party actions, locations, or safety conditions; or service interruptions or technical issues. You assume all risks when visiting physical locations or participating in any activities listed in the App.
13. Indemnification
You agree to indemnify and hold XPLR harmless from any claims, damages, liabilities, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
14. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which explains how we collect and use information.
15. Termination
We may suspend or terminate access to the App at any time for violating these Terms, fraudulent or harmful activity, or legal compliance. Upon termination, your right to use the App ends immediately.
16. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Davidson County, Tennessee.
17. Changes to Terms
We may update these Terms periodically. Continued use of the App after changes means you accept the revised Terms.
